Judge Richard J. Montelione - Professional Background & Legal Expertise

Biography

The Hon. Richard J. Montelione is an Acting Justice for the Kings County Supreme Court (Civil Term) in the Second Judicial District of New York.

Montelione earned a B.A. from the City University of New York at Queens College in 1978. After completing his undergraduate studies, Montelione served as a housing-credit specialist as a Volunteer in Service to America for one year. He then continued his studies at Antioch School of Law, where he completed a J.D. in 1983.

After graduating from law school, Montelione became an attorney with the Senior Citizens Project of the Nassau-Suffolk Law Services Committee in 1983. Two years later, he joined the Parole Revocation Defense Unit of the Legal Aid Society.

Then, in 1988, Montelione began serving as a principal court attorney for the Hon. Louis B. York (deceased) of the New York County Supreme Court. He worked in that capacity for two years, eventually leaving to practice as a principal litigation attorney at Montelione & Associates (1990 to 2005) and Lopez, Romero & Montelione (2006 to 2012). As an attorney in private practice, Montelione specialized in fraud, civil rights, business, and real estate matters.

Over the course of his legal career, Montelione served as a small claims arbitrator for the Civil Court of the City of New York in Kings County (1994 to 2012) as well as a special master for the New York State Unified Court System (1995 to 2003). He also taught as an adjunct professor at New York City Technical College.

Montelione was initially elected to the Civil Court of the City of New York in Kings County in 2013. Later that year, he was designated to the Criminal Court of the City of New York in Kings County by Chief Administrative Judge A. Gail Prudenti. He presided in that capacity until 2016, when he was designated Acting Justice of the Kings County Supreme Court by Chief Administrative Judge Lawrence K. Marks.

His professional memberships have included the Civil Court Committee, the Legislative Committee, and the LGBTQ Committee of the Brooklyn Bar Association; the Mentor/Mentee Committee of the Brooklyn Women’s Bar Association; the International Association of Lesbian and Gay Judges; Judiciary Committee of the New York City Bar Association; the New York State Trial Lawyer’s Association; the Special Master’s Committee of the New York County Lawyers Association; and the Lesbian, Gay, Bisexual, and Transgender Law Association of Greater New York (LeGal).

He has also served as a member of the Advisory Council to the Empire City Men’s Chorus; Vice-Chair of the Board of Directors of South Brooklyn Legal Services; and Vice-Chair of the Board of Directors of the McBurney YMCA.

Montelione is a life-long resident of Brooklyn, New York.

He is registered as a Democrat.
