Tentative Ruling: HEARING REQUIRED
This is a personal injury action following an injury plaintiff sustained to his knee while
participating in a recreational volleyball game. Before the Court this day are two defense
motions to compel plaintiff to provide further responses to Form Interrogatories, Special
Interrogatories, and the Request for Production of Documents. The court file does not contain
any opposition to the motions, which should have been filed a few days ago. See CCP §1005(b);
CRC 3.1300(a). There is also no follow-up filings from the moving party. Silence from both
sides is never a good thing because it permits three equally-plausible assumptions:
1) Plaintiff is unaware of the motions. This does not appear to be controlling based on the
accompanying proofs of service (using counsel’s new address) and counsel’….....
