The County of Marin’s (“County”) demurrer to the First, Second, and Third Causes of
Action of the complaint is sustained with leave to amend.
Allegations in Plaintiffs’ Complaint
Plaintiff alleges that the County is responsible for the upkeep, maintenance, inspection,
care, repair and/or restoration of the sidewalk, curb and area in between and/or adjacent to the
intersection of San Carlos Avenue and Bridgeway. (Complaint, §5.) On April 6, 2022, Plaintiff
tripped and fell on a damaged sidewalk near a fire hydrant at that intersection. (/d., 410.) The
