Defendant Marcus Sweezy’s request for judicial notice is DENIED. (Evid. Code, § 452.) The
documents are irrelevant to the Court’s determination of the motion. (Malek Media Group LLC
v. AXQG Corp. (2020) 58 Cal.App.5th 817, 825 [“Any matter to be judicially noticed must be
relevant to a material issue.”].)
Plaintiff Yolo County Housing Authority’s motion for summary judgment is DENIED. (Code
Civ. Proc., §§ 437c, 1170.7.) In its motion, plaintiff does not dispute that it is a covered housing
provider under the Violence Against Women Act (“VAWA”). (34 U.S.C.A. § 12491, subd.
(a)(3); 24 C.F.R. § 5.2003; Ps & As, p. 3; Vallejo decl., ¶ 3.) If plaintiff is a covered housing
provider, then it is required to provide VAWA notices with any notice of eviction at the property.
