Plaintiff Southport Yolo, LP’s unopposed motion to strike prejudgment claim to right of
possession and strike any responsive pleading related thereto is DENIED WITHOUT
PREJUDICE. (Code Civ. Proc., §§ 415.46, 1174.25, 1174.3.) Plaintiff failed to timely serve
the motion on claimant Rachel J. Carnett. (Code Civ. Proc., § 1005, subd. (b) [requiring that all
moving and supporting papers be served at least 16 court days before the hearing, plus two
calendar days for service by overnight delivery].)
If no hearing is requested, this tentative ruling is effective immediately. No formal order
pursuant to California Rules of Court, rule 3.1312 or further notice is required.
