Plaintiff Mayra Bermudez’s motion to compel deposition of the person most knowledgeable for
defendant Kia Motors America, Inc. is GRANTED IN PART, as follows:

As to matters for examination (“MFE”) nos. 1, 2, 4, 5, and 7, plaintiff’s motion is
DENIED AS MOOT. (Code Civ. Proc., §§ 2025.450, 2025.480.) Defendant represents
that it will provide a PMK deponent as to these MFEs. (See defendant’s separate
statement ISO opposition, pp. 1, 4, 6, 7, 11 [filed April 24, 2024].)

As to MFE nos. 3, 6, 8-16, 19-21, and 25-16, plaintiff’s motion is DENIED. (Code Civ.
Proc., §§ 2025.450, 2025.480.) Defendant represents that these topics are best addressed
by an expert witness, and plaintiff has failed to establish these topics must addressed by a
PMK deponent. (See, e.g., Code Civ. Proc., § 2025.….....
