Defendant Sacramento Colon & Rectal Surgery Medical Group, Inc.’s (the “Group”)
demurrer to plaintiff Jane Doe’s (“Plaintiff”) Third Amended Complaint (“3AC”) is ruled
upon as follows.

Plaintiff’s request for judicial notice of (1) the Court’s February 22, 2023, Minute Order
on the Group’s demurrer to the First Amended Complaint and (2) the 3AC is
GRANTED.

Plaintiff filed her initial Complaint against the Group and defendant Ranganath Pathak,
M.D. (“Dr. Pathak”) on April 15, 2022. Plaintiff filed her First Amended Complaint
(“1AC”) on September 22, 2022, which alleged fraudulent misrepresentation and
