Tentative Ruling

Plaintiff Fountain Oaks Ranch, LLC’s (“Plaintiff”) application for right to attach order and
writ of attachment against defendant and tenant Cal Restaurants (“CAL”) and its
guarantor, Gurtej Gill (“Mr. Gill”), is ruled upon as follows.

Plaintiff, a landlord, filed this action against CAL and Mr. Gill (collectively, “Defendants”)
for breach of lease and breach of guaranty to recover unpaid rent due under a written
lease and guaranty regarding commercial property at which Defendants were operating
a pizza restaurant.

The Retail Lease (the “Lease”) was entered into by and between Plaintiff’s predecessor,
5511 Sunrise, LLC (“Sunrise”), with CAL on January 28, 2019, and Mr. Gill executed a
Guaranty of Lease (the “Guaranty”) the same day. (Declaration of
