Having considered the moving papers, the Court rules as follows.
BACKGROUND
On June 29, 2020, Plaintiff Debra Garcia (Plaintiff) filed a complaint against Defendants City of Cerritos (City or Defendant), County of Los Angeles (County), George W. Lucas as Trustee of Lucas Family Trust (George) and Donna L. Lucas as Trustee of Lucas Family Trust (Donna) for general negligence and premises liability.
On January 29, 2021, George and Donna filed a general denial. On February 4, 2021, the City filed an answer.
On March 17, 2021, George and Donna filed a Cross-Complaint against Cross-Defendant City for indemnification, apportionment of fault, and declaratory relief. On April 20, 2021, the City filed an answer to the Cross-Complaint.
On April 20, 2021, the Corut dismissed the County, with prejudice, pursuant to Plaintiffs request. The Court l
