Background/Procedural History.
This is a dispute over parking spaces at the property commonly known as Avila Village.
On March 28, 2018, Avila Village II LLC, Robin L. Rossi, Trustee of the Robin L. Rossi Living Trust UTD October 19, 1990, Once Upon a Time L.P., Lexington Real Property Partners LLC, and Covelop Holdings LLC (collectively “the Rossi Plaintiffs”) filed a lawsuit against San Luis Bay Estates Homeowners Association (“Defendant Association”). The Rossi Plaintiffs’ first amended complaint (“FAC”) asserts causes of action for (1) declaratory relief, (2) injunctive relief, (3) “per se, private and public nuisance,” (4) accounting, (5) writ of mandate under Code of Civil Procedure1 section 1085, (6) writ of prohibition under Sections 1102-1103, and (7) breach of 2000 agreement. The FAC alleges that Plaintiffs are property owners of certain lots of real property located in San Luis Bay Estates (the “Property”). According to the San Luis Bay Estates Master Plan (th
