KATHLEEN B. DOWLING, being duly swom deposes and states:
1 I am the sister of the Plaintiff in this action, MARY MARGARET BUTLER, and
Tam fully familiar with the facts and circumstances set forth herein.
2. Thave been advised that my sister has filed a motion and an action with this Court
seeking the issuance of relief that would allow her to remain in her cooperative apartment. I
have been further advised that for my sister to remain in her apartment she may be called upon
to
provide funds to the Defendant in this action in the approximate amount of $ 140,000.00 (the
“Arrears”).
3 My husband, Michael J. Dowling, and I stand ready, willing and able to provide
my sister with such funds as may be required to pay the Arrears. My husband and I have several
accounts from which we could fund the Arrears, but in the interests of protecting our
own
financial privacy I attach hereto a statement from one account we could use for paying
the
Arrears in full. (A copy a U.S. Trust account statement from September 2014 is attached hereto
as Exhibit “A”),
WHEREFORE, it is respectfully submitted that Plaintiff's motion be granted
in all
respects together with such other and further relief as the Court may deem just and
proper.
