                        PLEASE TAKE NOTICE that defendant the Estate of Disque D. Deane (“the Estate”),

           by Carol G. Deane as Temporary Executrix, hereby appeals to the Supreme Court of the State of

           New York, Appellate Division, First Department, from the Decision and Order of the Supreme

           Court, New York County (Kornreich, J.), dated May 22, 2014, and entered in the office of the

           Clerk of the County of New York on July 30, 2014, granting plaintiff Harvey Rudman’s motion

           for summary judgment dismissing the counterclaims for breach of fiduciary duty and unfair

           competition asserted against him by defendant the Estate.        This appeal is from the whole of said

           Decision and Order, and from every part thereof.
