Dear Justice Kornreich:
We are counsel to Plaintiffs in the above referenced case. We write regarding the
Court's recent inquiry concerning the notice provided to Defendant Starrett City Preservation
LLC ("Preservation") of Plaintiffs' motions for the issuance of a commission for an out of state
subpoena to Choate Hall & Stewart LLP and for the issuance of a subpoena to the New York
City Department of Housing Preservation & Development pursuant to CPLR 2307. At the time
Plaintiffs filed and served the two motions, Kenneth Warner, who represents other Defendants in
this action, had already advised me that he would be representing Preservation. His firm
subsequently filed an Answer on behalf of Preservation. Mr. Warner was provided with notice
of the aforesaid motions.
All Defendants have been provided with notice of the above mentioned motions, and we
respectfully request that the commission addressed to the Massachusetts Superior Court be
executed by the Court and that the subpoena to HPD be issued.
