Supreme Court, New York County Index No. 650159/2010 Dear Justice Kornreich: We are counsel to Plaintiffs in the above referenced case. We write regarding two motions: one for the issuance of a commission for an out of state subpoena to Choate Hall & Stewart LLP ("Choate"), and one for the issuance of a subpoena to the New York City Department of Housing Preservation & Development ("HPD") pursuant to CPLR 2307. Both motions were unopposed and their return dates have passed. The motion concerning the issuance of an open commission was fully submitted on July 1, 2011, and the motion concerning the issuance of a subpoena to HPD was fully submitted on June 24, 2011. We respectfully request that the order for a commission and the commission addressed to the Massachusetts Superior Court be executed by the Court, and that the subpoena to HPD be issued.
