Dear Justice Kornreich:
We are counsel to plaintiffs in the above-referenced action.
Enclosed is a courtesy copy of Plaintiffs' Motion To Compel Documents and
Testimony withheld under the Kovel extension of the attorney-client privilege invoked by the
defendants (the "Motion"), including (i) a Notice of Motion, (ii) Affirmation of Jacqueline G.
Veit in support of the Motion, with exhibits, and (iii) a supporting Memorandum of ~.aw.
The Motion includes portions of deposition transcripts and references thereto that
defendants have designated confidential. In accordance with paragraph 12 of the Confidentiality
Order entered in this case, we have refrained fri~m filing the IVlotion on the ECF system while
defendants have an opportunity to file a motion to .seal. Given the shortened briefing schedule of

2012, whether they intend to file a motion to seal. A copy of the Confidentiality Order is also
