Dear Justice Oing:
This firm represents Humanscale Corp. (“Humanscale”) in the above-referenced
matter in which Humanscale has moved to vacate the Note of Issue (“NOI”) filed by
Plaintiffs.
A hearing on Humanscale’s motion is currently scheduled before Your Honor on
January 14, 2015 beginning at 10:30 a.m. Counsel for Humanscale will be returning from a
preplanned vacation scheduled for around this same time. Accordingly, Humanscale
respectfully requests the hearing on its motion be rescheduled for a date convenient for the
Court. Plaintiffs’ counsel consents to Humanscale’s request to reschedule the hearing.
Pursuant to Your Honor’s Individual Rules, this is Humanscale’s first request for an
adjournment on its motion to vacate the NOI. Also pursuant to Your Honor’s Individual
Rules, the parties propose either January 21, 2015 or January 28, 2015 to reschedule the
