Dear Judge Oing:
This firm represents Defendant, Humanscale Corp. (“Humanscale”), in the above-referenced
matter. We are writing concerning Humanscale’s Motion for a Commission requesting the Superior
Court of the State of New Jersey to issue a subpoena ad testificandum and duces tecum to non-party
Tri-Dim Filter Corporation (the “Motion”).
Plaintiffs filed an Affirmation in Partial Opposition to the Motion, and while Humanscale
disputes Plaintiffs’ assertions therein, on the only issue before the Court of whether to issue the
Commission, Plaintiffs confirmed they do not oppose. With the Motion now fully submitted,
Humanscale respectfully requests a conference with the Court so that the Commission may be
issued and discovery thereunder proceed as quickly as possible.
