CADER, being duly sworn, hereby deposes and says: 1 I am an associate with the law firm of Davidoff Hutcher & Citron LLP, attorneys for Plaintiff, ANT GENERAL CONTRACTING, LLC (“Plaintiff”) in the above captioned matter. 2 I am fully familiar with the facts and circumstances of this action and have personal knowledge of the facts set forth herein. 3 On March 12, 2013, Plaintiff and Defendants SLATMARI DEVELOPMENT LLC and GERGELY SZATMARI a/k/a GREG SZATMARI entered into a Stipulation and Order of Settlement (the “Stipulation”) in settlement of the within action. Exhibit A. 4. In addition to the Stipulation, Defendant GERGELY SZATMARI a/k/a GREG SZATMARI executed an Affidavit of Confession of Judgment on April 1, 2013, in which he confessed judgment in the amount of $30,000.00. A copy of the Affidavit of Confession of Judgment is filed herewith. 800990S4v.4 5 Pursuant to the Stipulation, Defendant agreed to submit seventeen (17) monthly payments beginning April 15, 2013 and ending September 15, 2014. And, if any check was not presented when due, and any default not cured or any payment not honored upon presentment, then Defendant authorized the submission of the Affidavit for Judgment by Confession for entry. 6 Defendants made the first payment, in the sum of $2,000, and failed to make any further payment. Thus, Defendants are in default under the Stipulation. Under the terms of the Stipulation, in the event of a default, Defendants are liable for the sum of Thirty Thousand Dollars ($30,000), less any payments actually made. 7 Plaintiff has provided Defendants with a written notice of the default and Defendants have not cured same. 8 Accordingly, Plaintiff is entitled to file and have execution upon the Confession of Judgment in the amount of Twenty-Eight Thous: Dollars ($28,000). onathan M.
