DeCarlo, vacating the arbitration award of Arbitrator Jonathan Hill, and re-
instating the award of Arbitrator Timothy McNamara issued In the Matter off
Eternity Acupuncture, P.C, a/a/o Tayana Sagalovich and Mapfre Ins. Co. of New|
York, American Arbitration Association Case No. 412013033093; or, in the|
aliernative,
i modifying the award of Arbitrator Jonathan Hill issued In the Matter of Eternity|
Acupuncture, P.C. a/a/o Tayana Sagalovich and Mapfre Ins. Co. of New York, by|
confirming those parts that denied reimbursement based upon a lack of medical]
necessity, and vacating the monetary award in total, which exceeded the power of
the arbitrator based upon the exhaustion of the policy limit; and
iti for such other and further relief that this Court deems just, proper and equitable.
PLEASE TAKE FURTHER NOTICE, that pursuant to CPLR §2214(b), answering
Affidavits must be served at least seven (7) days prior to the return date of this Petition.
