PLEASE TAKE NOTICE that upon the affirmation of Stephen Vlock, Esq., dated June 20,
2024, the affirmation of Richard Gipstein, dated June 20, 2024, and the exhibits annexed thereto,
Plaintiff will move this Court, at the courthouse located at 111 Dr. Martin Luther King Jr.
Boulevard, White Plains, New York, at an IAS Part to be assigned, on September 4, 2024, at
9:30 A.M., or as soon thereafter as counsel may be heard, for an Order pursuant to CPLR § 3213,
granting summary judgment in lieu of complaint in favor of Plaintiff, and directing that Plaintiff
recover against Defendants the sum of $87,677.81 as of June 13, 2024, plus interest thereafter
through entry of judgment in this Court, together with the costs and disbursements of this action,
and such other and further relief as the Court deems just and proper, upon the ground that this
action is based upon breach of a settlement agreement between Plaintiff and Defendants.
This action is not on the trial calendar.
