NOTICE: The nature of the action is a summary proceeding, initiated by motion for summary judgment
in lieu of complaint, pursuant to CPLR 3213, to obtain judgment upon and renewal of a June 9, 2014
judgment, in the amount of $544,896.00, entered by the New York Civil Court, Kings County District
Court, docketed on June 9, 2014, in an action captioned Connnonwealth Land Title Insurance Company v.
Ralph Pecorale, Cheryl Filkowski, Ira Waltuch, Legend Abstract, LLC., d/b/a Legend Land Services, Joyce
Halls, Donna Daniels a/k/a Joyce Halls and Noni White Index No. 75963-10, with such renewal judgment
to entered under an amended caption pursuant to CPLR 5019 to omit parties who have previously been
omitted from the effect of the prior judgment by stipulation or prior settlement, to add an alias for one
defendant, and to provide for interest to run thereupon at the 9% statutory rate, and for such other and
further relief as to this court may seem just, equitable, and proper.
The relief sought is an order directing entering a renewal judgment against you in an amount not less than
$1,021,321.10 which constitutes the amount of the Judgment, plus all interest accruing thereupon since
ently, with credits for payments received from certain defendants named herein.
Should Defendants fail to appear herein, judgment will be entered by default for the sum of at least
$1,021,321.10, plus costs and statutory interest to run thereupon from the date of entry.
VENUE: Plaintiff designates Nassau County as the place of trial. The bases of this designation are: The
residence of at least two Defendants in Nassau County, either currently or at the time of the underlying
transactions forming the basis of this action.
