        PLEASE TAKE NOTICE that upon the Affidavit of Issac Katz, dated October 27, 2023,

the Affirmation in Support of Angelyn Johnson, Esq., dated October 27, 2023, the exhibits annexed

thereto; and together with all the prior pleadings and proceedings hereto had herein,

        LET petitioner, Jordan Bardach, show cause before this Court in Part 54, Room 228 at the

Courthouse located at 60 Centre Street, New York, New York 1007 on ______________, 2023 at

9:30 a.m., or as soon thereafter as counsel may be heard, why an Order should not be made and

entered:

             a)    Pursuant to 22 NYCRR § 1200 and Rules 1.7 and 1.9 of the New York
                   Rules of Professional Conduct, disqualifying counsel Brett G. Canna, Esq.
                   of Liberman & Canna LLP from representing petitioner is this matter due
                   to a clear and irreconcilable conflict of interest;

             b)    Granting Nominal Respondent such other and further relief as the Court
                   deems just, proper and equitable.
       SUFFICIENT CAUSE THEREFORE APPEARING, it is hereby,

       ORDERED, that pending the hearing and determination of the within motion, all

proceedings in the above-captioned action, including all proceedings as directed pursuant to the

Court’s Interim Order, dated October 6, 2023, including the hearing scheduled for November 6,

2023 at 10:00 a.m., are hereby stayed, and it is further,

       ORDERED, that NYSCEF upload service of a copy of this Order to Show Cause and the

papers upon which it is based, upon Brett G. Cannon, Esq., counsel for petitioner, on or before

October ______, 2023, shall be deemed good and proper service thereof.
