12, 2023, and upon the exhibits annexed thereto in support thereof, the plaintiff will move this
court at an IAS Part at the Supreme Court of the State of New York, County of Suffolk, One
Court Street, Riverhead, NY 11901, on February 7, 2024, at 9:30 A.M. or as soon thereafter as
counsel can be heard for an order granting summary judgment for plaintiff in lieu of complaint
and directing that plaintiff recover of defendant the amount of $50,000.00 with from June 23,
2023, together with the costs and disbursements of this action and such other and further relief as
the Court may deem just and proper, upon the ground that this action is based upon an instrument
for the payment of money only pursuant to CPLR § 3213.
The above-entitled action is based on a promissory note. This action is not on the trial
calendar.
