CASE NO. 28-2022-CA-000451 MICHAEL DESLANDES and ZYNOBIA DESLANDES, Defendants, / AFFIDAVIT IN SUPPORT OF PLAINTIFF’S MOTION FOR SUMMARY FINAL JUDGMENT OF FORECLOSURE B EFORE ME, an officer authorized to take oaths, this day personally appeared Dane. Goclbaghouse. for Sun N’ Lake of Sebring Improvement District (the “District”), who being duly sWorn, deposes and says: 1 I am authorized to execute this affidavit as Finonce Direcko of Sun N’ Lake of Sebring Improvement District. In 1974, Highlands County created Sun ‘N Lake of Sebring Improvement District to fund the construction and maintenance of infrastructure for the property located within its boundaries. The District is classified as an independent special district pursuant to Chapter 189, Florida Statutes. As such, the District is authorized to (1) collect operational and maintenance assessments, (2) issue special assessments, and (3) issue bonds to fund the infrastructure of the community. The information in this affidavit is taken from the District’s business records and my personal knowledge. My position as i I Pinowce- requires me to be familiar with and understand the District’s business records. Ihave personal knowledge of the District’s routine practices and procedures for making and maintaining the records I am testifying about. They are: (a) made at or near the time of the occurrence of the recorded matter(s); (b) made by, or from information transmitted by, persons with personal knowledge of the recorded matter(s); (c) kept in the course of the District’s; and (d) it is the regular practice of the District to make such records. According to the business records I reviewed, MICHAEL DESLANDES and ZYNOBIA DESLANDES are the record owners of the properties located within the Sun N’ Lake Improvement District, having the following addresses: a. 5009 San Ignacio Dr, Sebring, FL 33872; and b. 6437 Alcala Ave, Sebring, FL 33872. The District issues a yearly maintenance assessment. Notice of the maintenance assessment is delivered to each unit owner in October with payment due on or before March 31st of the following year. Such notice is mailed to the record title owner’s address provided to the Property Appraiser for Highlands County, Florida, or as otherwise provided to the District. The District also issues a yearly bond assessment. Notice of the maintenance assessment is also delivered to each unit owner in October with payment due on or before March 31st of the following year. Such notice is mailed to the record title owner’s address provided to the Property Appraiser for Highlands County, Florida, or as otherwise provided to the District. MICHAEL DESLANDES and ZYNOBIA DESLANDES are in default of the assessments due on the properties as follows: a. 5009 San Ignacio Dr, Sebring, FL 33872 in the principal amount of $33,914.72 for failing to make the payments due on March 31, 2009, and all subsequent payments. b. 6437 Alcala Ave, Sebring, FL 33872 in the principal amount of $33,914.72 for failing to make the payments due on March 31, 2009, and all subsequent payments. 10.
