FROM ORDER APPOINTING AND DIRECTING SCHEDULED MEDIATION
The Defendants, MARK S. TRACY, D.P.M. and MARK S. TRACY,
D.P.M., P.A., by through their undersigned attorneys files this
Motion for Relief from Order Appointing and Directing Scheduled
Mediation and as grounds in support thereof states as follow:
1. On October 10, 2001, this Court sua sponte entered an
Order Appointing and Directing Scheduled Mediation for Thursday,
November 8, 2001 at 9:0C a.m.
2. Pursuant to paragraph 14 of this Order, these Defendants
seek to schedule a mediation with a person unaffiliated with the
court mediation program at a date and time convenient to all
parties, their clients and, if applicable, their adjusters.
3. Upon receipt of this order, undersigned counsel and
counsel for the Plaintiffs discussed the order and both sides are
agreeable to holding a mediation on a mutually convenient date at
