Defendants Bala K. Nandigam, M.D. and Charlotte Medical Associates, P.A.
answer the Amended Complaint and say:
1. They deny each allegation to which a response is not otherwise made.
2. They admit the allegations of paragraphs 15, 16, 36 and 37.
3. They deny that Dr. Nandigam was negligent, but admit the remaining
allegations of paragraph 59.

ion4. They are without knowledge as to the allegations of paragraphs 47 through
57 and 60 through 69.
FIRST AFFIRMATIVE DEFENSE
5. The negligence of plaintiff and plaintiffs decedent was a proximate
contributing cause of the injuries, death and damages of which plaintiff complains.
ECOND AFFIRMATIV! FENSE
6. Plaintiff and the beneficiaries of this action have available to them collateral
source payments and these defendants are entitled to a reduction of any award to
plaintiff by the total of such payments.
THIRD AFFIRMATIVE DEFENSE
7. Plaintiffs damages, if any, were caused wholly or in part by the negligence of
third persons over whom these defendants had no custody or control, and therefore
these defendants cannot be held liable, or their liability should be reduced
proportionately.Certificate of Service
