DEFENDANT, SAMUEL ESTEPA, M.D.’S OBJECTIONS TO REQUEST FOR
ADMISSIONS DATED AUGUST 29, 2000 AND
REQUEST FOR ADMISSIONS DATED SEPTEMBER 6, 2000

Defendant, SAMUEL ESTEPA, M.D., objects to the Request for Admissions
dated August 29, 2000 and the Request for Admissions dated September 6, 2000 as follows:
1. Defendant objects to this request because it would require disclosure of
information that constitutes work product. The arguments and position which a defendant takes
at trial are entirely dependent on counsel’s strategy and are, therefore, privileged from discovery.
Smith v. Florida Power & Light Co., 632 So.2d 696 (Fla. 3d DCA 1994). There is, however,

evidence in the record from which a reasonable person could conclude that Dr. Koerper deviated
from the standard of care. See deposition of Dr. James White.
