               AFFIRMATIVE DEFENSES TO PLAINTIFFS’ AMENDED COMPLAINT

COME     NOW the Plaintiffs, DEBORAH                      COOPER BURG, by and through her Court-

appointed Guardian, RICKY BURG; NICOLE BURG, her daughter; and RICKY BURG, her

spouse, by and through their undersigned attorneys, and file their Reply to Affirmative

Defenses    raised    by the       Defendant,         AHSAN         KAMAL,        in his Answer            to the Amended

Complaint and state as follows:

       1       All Affirmative Defenses are denied unless specifically admitted herein.

       2       The Plaintiffs demand trial by jury of all issues so triable.

       3       As to the Defendant, AHSAN KAMAL’s First, Fourth, Sixth, Seventh, Eighth,

Tenth, Fifteenth, Sixteenth, Seventeenth and Twenty-Second Affirmative Defenses, the

Plaintiffs state that these are not valid applicable defenses as a matter of law pursuant

to Stuart v. Hertz, 351 So.2d 703 (Fla. Sup. Ct. 1977), and its progeny.

       4.      As to the Defendant, AHSAN KAMAL's Ninth Affirmative Defense, failure to

mitigate damages is not a valid affirmative defense by law.

       5       As to the Defendant, AHSAN KAMAL's Thirteenth Affirmative Defense, it is

known or should be known to Defendant, AHSAN KAMAL, that his Thirteenth Affirmative

Defense as to the Statute of Limitations is without application and, in fact, gives rise to

Florida Statute 57.105 sanctions for being pled.

       6.      As to the Defendant, AHSAN KAMAL'’s Nineteenth, Twentieth and Twenty-

First Affirmative Defenses, these represent a non-existent statement of the law and are

without legal application or applicability.
