Kristin Etu, Nathan Etu v. Kohinoor Akther, Pomona Seneca, Llc

Defendants Kohinoor Akther and Pomona Seneca, LLC, claim to have purchased and claim to be

the owner of a residential building known as 131 North Park Avenue, Buffalo, New York, 14216

(“the Premises”). The purchase was “as-is” and includes the existing tenants and their rights.

The purpose of the purchase was for the corporation to buy the house, do minimal repairs and

“flip” the house to maximize profits. Defendants have received repeated and continuous from

the existing tenants to make repairs to alleviate dangerous and unhealthy living conditions but, to

date, Defendants have expressly refused to make any repairs to the Premises which Plaintiffs

believe is in an effort to force Plaintiffs – who are on disability – to voluntarily flee from their

residence before a lengthy eviction battle. Based on a phone call from KeyBank, Defendants

have refused to insure the property and, upon information and belief, are doing everything they

can to avoid expenses and so that they can cover up the dangerous conditions before flipping the

home to unsuspecting buyers. Accordingly, Plaintiffs have been left with no choice but to bring

4. Negligence Infliction of Emotional Distress

5. Breach of the Warranty of Habitability
